Used Racket Sale Policy
Section I: Introduction and Purpose
This policy is promulgated by Padel For Less (“Company”) to establish a clear and unambiguous framework within which individuals (“Sellers”) may offer used padel rackets (“Item” or “Items”) for sale through the Company’s online store and associated social media platforms (the “Platforms”). This policy binds Sellers to accurately represent Items and to maintain the condition of such Items post-approval by the Company until the completion of the sale and collection by the Company.
Section II: Seller Representations and Warranties
-
Accuracy of Information: Upon completion and submission of the "Sell My Padel Racket" form (the “Form”), the Seller warrants that all information provided therein is complete, truthful, and accurate. This encompasses, but is not limited to, the make, model, condition, and history of the Item.
-
Photographic Evidence: Images supplied by the Seller in support of the Form shall be representative of the Item’s current condition and be void of any alterations that may distort the appearance and condition of the Item.
Section III: Approval and Obligations Post-Approval
-
Approval Process: The Company will, in its sole discretion, assess the Item based upon information and photographic evidence provided. Should the Company deem the Item to be suitable for sale via the Platforms, written confirmation of approval shall be furnished to the Seller.
-
Maintenance of Condition: Subsequent to the Company’s aforementioned approval and prior to the transfer of possession, the Seller agrees and covenants to maintain the Item in a state identical to that warranted by the Seller and approved by the Company.
-
Inspection Upon Collection: At the point of order by a purchaser (the “Purchaser”) and collection by the Company or its agents, the Item will be subject to a condition inspection. The Seller acknowledges that the Item must be found in the same condition as at the time the Company delivered the approval confirmation.
Section IV: Breach of Policy
Should the Item, upon inspection, fail to meet the approved condition, it constitutes a breach of this policy and the Seller shall be subject to the following:
-
Cancellation of Sale: The Company retains the right to cancel the sale of the Item, with immediate effect, without liability to the Seller or the Purchaser.
-
Indemnification: The Seller shall indemnify the Company against all losses, damages, and costs incurred by the Company that arise due to the Seller’s misrepresentation of the Item or failure to maintain the approved condition of the Item.
-
Removal from Platforms: The Company may elect to remove the Seller’s access to the Platforms and disqualify the Seller from future use of the Company’s services.
Section V: Governing Law
This policy shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company operates. Any disputes arising hereunder shall be adjudicated exclusively in the courts of said jurisdiction.
Section VI: Amendments
The Company reserves the right to amend, revise, or replace this policy at any time. Continued use of the Platform by the Seller following any such changes constitutes acceptance of the new terms.
Section VII: Acceptance of Policy
By submitting the Form, the Seller unequivocally accepts the terms of this policy.
